Mom Killed the Kids, but at Least They Didn't Give Dad Custody

February 25th, 2008 by Glenn Sacks, MA for Fathers & Families

"She wanted to kill them. I let the court know that. But they took only one side...I loved them. I've been fighting for them."

Note that the woman, apparently a violent lunatic who allegedly had sent her ex threatening letters and set fire to his car, was granted an order of protection. Now, despite the fathers' repeated warnings to social workers, the kids are dead.

But at least they didn't give dad custody...

'Nassau County killed' them, boys' father cries
BY OREN YANIV and JANE H. FURSE
NY DAILY NEWS
February 25th 2008

The grieving father of two boys allegedly killed by their disturbed mother said social workers failed to heed his warnings they were in danger.

"Nassau County killed these kids," said Innocent Demesyeux, 28, who claimed county authorities ignored his pleas to protect Michael, 5, and Innocent Jr., 18 months, from their "violent" mother, Leatrice Brewer, 27.

Demesyeux, an ambulette driver who has been estranged from Brewer since 2004 and was locked in a custody battle with her, said he warned authorities she had threatened to kill the children as recently as last week.

"She wanted to kill them," Demesyeux told the Daily News. "I let the court know that. But they took only one side."

He said Brewer called him on Wednesday or Thursday sounding "crazier than normal," claiming people on MTV were talking to her and saying "they were making fun of her on TV and that this Spanish woman put voodoo on her."

A custody hearing was scheduled for today in Mineola Family Court, and fear of losing custody also may have caused Brewer to "snap," said Desmesyeux.

He said Brewer's violent behavior - including threatening letters and a 2004 incident in which she burned his car - has been going on for years.

Although she petitioned the court for an order of protection against him, he said she continued to be obsessed with spending time with him - resulting in the birth of Innocent Jr. 18 months ago.

"She basically was playing mind games," he said, saying that during her call last week, "she told me she wanted me to come over" even though she had an order of protection.

"I loved them," Desmesyeux said numbly. "I've been fighting for them."

  1. Bernie Misiura Says:

One can only hope that Nassau county will be held accountable. Also this is one reason that I do not believe in the ability of a parent to "kidnap" his own kids. In this situation believing my children were in mortal danger I would have the moral and ethical duty to act if the legal system would not.

    b

  2. Mark Ruffolo Says:

Demesyeux drove Brewer to murder their children. She is the victim.

For the children's safety, the family judge ought to suspend visitation and an order of protection ordered for the sack of the children. After a criminal judge finds him guilty of accessory to murder, the judge ought to sentence him to prison.

A memorial ought to be established in memory this brave woman. Maybe a charity walk organized. Oprah and The View, with the government, can help create an awareness campaign against domestic violence.

  3. Danny Says:

And that sad thing Bernie is that if you did act if the legal system failed to the legal system would then act and come after you with all its might and somehow your "kidnapping" would outweigh her death threats.

If I'm not mistaken didn't Glenn use a headline similar to this a few months ago?

  4. Dave M Says:

WARNING! WARNING! Even though warning signs were obvious, gender bias is more important.

Every parent should have the right to have a person they suspect of being unfit take a psychological test like an MMPI-3. They in fairness should also be required to take one themselves to prevent bias.

  5. Demonspawn Says:

And that sad thing Bernie is that if you did act if the legal system failed to the legal system would then act and come after you with all its might and somehow your "kidnapping" would outweigh her death threats.

And when you have no legal recourse to resolve your problems, what is the only logical answer remaining?

  6. Mark Ruffolo Says:

Also, Nassau County Department of Social Services ("IT SHOULDN'T HURT TO BE A CHILD") should be given more tax payer money (federal and state) to hire more people and create programs.

Social Services does not have the resources to help fight victimization of woman and children in the traditional family setting.

  7. callum Says:

She's the obvious psycho, but still she tries to get a restraining order on him.

Either women KNOW they will be granted one regardless of any evidence. Or it's a common female tactic. Having seen the ways boys and girls bully, I would suggest both.

This should really be taken into account when always granting restraining orders.

  8. Sungjun Says:

If they had given the dad custody, surely the kids would've been killed sooner?

Only ABUSIVE dads want custody, after all.

  9. Doug Dante Says:

I'm deeply saddened by Desmesyeux's loss. It's too late for his children, but not too late for others who may be in danger.

I'm not a lawyer and this is not legal advise.

However, I have to wonder, was this an honest mistake?

Did the workers who made a custody recommendation for mom, even when the evidence indicated she may be a danger to her children, have financial conflicts of interest when doing so? Unfortunately, they often do.

    http://www.scribd.com/doc/630611/A-Quick-Summary-of-Title-IVD-Funding-and-Incentives

Were the mediators and counselors who examined this case properly trained? Were they neutral as constitutionally required, or did they side with mom for reasons of money or sexism?

    http://www.scribd.com/doc/405400/Michigan-Friend-of-the-Court-Mediator-Questions

How long was this custody hearing in coming? I've heard of other cases where custody hearings were dragged on way beyond customary limits when the likely ruling based on the facts was to switch custody from mom to dad:

    http://www.scribd.com/doc/509712/What-if-The-Court-Fails-to-Rule-Promptly-on-Custody

    Was there evidence of racketeering?

    http://www.scribd.com/doc/454566/Racketeering-in-Michigans-Friend-of-the-Court

Perhaps Mr. Desmesyeux could find some solace in filing a federal racketeering lawsuit in order to bring attention to this problem and to help the other children who may be endangered by a racket.

    http://www.scribd.com/doc/959159/When-Might-a-Federal-Racketeering-Lawsuit-Be-Allowable

There's also the possibility that Mr. Desmesyeux could find solace in suing the locals in federal court on the grounds that his civil rights to father his children were violated by a court more focused on their own pocketbooks or their own politics, or both, than in doing their duty properly, ensuring the safety of his children, as well as his rights as a parent:

    http://www.scribd.com/doc/404652/Fiction-John-Q-Public-and-the-Friend-of-the-Court-Before-It-Begins

In the end, Mr. Desmesyeux has suffered a horrific loss. Perhaps it was just human error. Perhaps it was political, anti-father bias, perhaps it was part of a racketeering conspiracy to maximize federal funding without any real regard toward his rights and the safety of his children.

Mr. Desmesyeux, and others like him, might get some from this, some way to help others, if they get the people involved up on a witness stand and in front of a good lawyer, who will know how to extract the truth.

And quite possibly save the lives of other children in the process.

  10. Mike Says:

Dave M Says: "WARNING! WARNING! Even though warning signs were obvious, gender bias is more important. Every parent should have the right to have a person they suspect of being unfit take a psychological test like an MMPI-3. They in fairness should also be required to take one themselves to prevent bias."

Dave, don't you comprehend yet that psych evals and psych testing are primarily mean to continue to interfere and block a child's fathering (and the father's contact with HIS alleged children)? (Dave, I suspect you know all this.)

    Mike

  11. Miles Says:

The grandmother thinks "The system failed her" and the sister calls her a "good", "loving" person.
    Once again, no accountablity.
How about 2 months in psychiatric care then let her go - that sounds about "Mary Winkler" right.

    = = =

I am sure you are right. But I would hve the satisfaction of doing the right thing, and my children would be alive. Some decisions are very difficult and do come with a cost.

  13. Stephen M Weiss Says:

Another round of victims of Family Law.

By the way, I don't really expect the Government to protect children from their own parents. I don't expect the government to keep this level of conflict up either.

The last thing parents who are unstable need is traumatic custody battles.

  14. David M Says:

Mike- I didn't know this. My daughters mom has borderline personality disorder. I asked the courts to test both of us and I would pay for the testing.

The biased Judge lectured me for infering that this "poor mother of two small children could have something mentally wrong with her."

A test would have given credibility to my arguement but it was not allowed.

  15. The Ex-Husband Says:

People think I joke when I say, "In too many cases, the father only gets custody of his children after they are dead." Here's a prime example. He'll get custody long enough to bury them.

  16. Bernie Misiura Says:

    David M

    How irresponsible of you!

    b

  17. The Ex-Husband Says:

David M. - I did the same thing and was saddled with such a horrendous, biased, and fraudulent custody evaluation that my disgusted judge saw fit to throw the entire thing out of court... which included testing indicating that she had a personality disorder and I did not.

Right now, I am clinging to my 50/50 custody with all my might and praying that nothing untowards happens to my children in the interim.

  18. David M Says:

    The Ex-Husband.

Amazing. The Judge allows the testing and then throws it out because he doesn't like the results.

I'm sure he reimbursed you for the testing costs?

  19. George Says:

If I'm not mistaken didn't Glenn use a headline similar to this a few months ago?

Something similar to this probably happened a few months ago.

  20. George Says:

    David M, and Ex-Husband:

I don't know how these things get done, but I would be worried that the evaluation came out biased. Then you'd really be in an Orwellian headfuck.

    Maybe we're all wrong.

  21. AnonymousPamphleteer Says:

"A custody hearing was scheduled for today in Mineola Family Court, and fear of losing custody also may have caused Brewer to "snap," said Desmesyeux."

Yes, family court-caused "snapping" is behind countless murders in America.

By contrast, if the iron-clad law in America were 50/50 custody, and there was therefore nothing to "lose", how many murders would America's family courts be able to claim to its credit?

    Very, very few, one suspects.

Ah, but setting up "custody battles" is such a profitable business, now isn't it? And it makes "judges" appear so powerful and important. What a wonderous rush for them. What a gusher of money for their lawyer and court hanger-on "expert" buddies.

And Family court's "work" is apparently profitable for funeral homes too.

Today, America's greed- and power-crazed family courts are squatting arrogantly at the causal end of the causality trail leading to a vast number of murders of innocents in America. Innocent children. Innocent mothers. Innocent fathers.

In this case, a woman who clearly should have been hospitalized for her own mental health was instead driven by the vicious nature of the American family court process, to do the worst she was capable of -- murdering her children.

And if this father had the ongoing proximity that would have been the case under 50/50 custody, maybe he could have helped the mother get to a hospital -- rather than the arrogantly "deaf-to-the-father's-pleas" American "family" (sic) court sending these children to their graves.

America's family courts need to be shut down permanently before they cause any more murders. By my calculations, they have already killed more Americans since 9/11 than the 9/11 incident, and the U.S. invasions of Afghanistan and Iraq combined.

That's a lot of dead Americans.

So who is the greatest and most deadly terrorist enemy of America today?

Based on total body count, that would be America's family courts, that's who.

    Think about it.

You'll realize it is absolutely true.

  22. Mark Ruffolo Says:

The problem of America's anti-male social policy is big.

The government school's women's study and social psychology programs are feeders for the government's social programs and court system for divorce industry.

In school, students learn how corrupt men are; men created the patriarch; the bible is written by men for men; men took the Indian's land, and men enslaved blacks and wives. Academic is happy to publish government paid research to support that men are bad. Text books for history and social sciences were rewritten about forty years ago

After graduation, women armed with a government financed graduate degree are then hired by a social service agency. The agency is either government operated or government funded.

My ex-wife and many of her girlfriends took this path. Hey usually quit these jobs after they have kids as they learn the pay is low for having an advance degree.

Later when these women, who work in social services, desire to divorce the husband, the women are well informed of the 911, police procedures for domestic violence, family court policy and procedure, GAL (kids attorney), and psych evaluators.

  23. Mark Ruffolo Says:

Dr. Mike Adams writes about feminism's influence in public (read: government) universities. Here's his latest article.

"The Vagina Monologues think that anything goes as long as they are willing to donate the proceeds to a worthy cause like a local domestic violence shelter."

" At Georgia Tech a couple of years ago the feminists used the “c-word” during The Vagina Monologues. When a couple of brave young ladies named Ruth and Orit put up a “We are not (c-words)” poster on campus, the feminists tried to censor them claiming the c-word is offensive unless uttered by a feminist."

    http://townhall.com/columnists/Column2.aspx?UrlTitle=litigation,_castigation,_and_donation&ns=MikeSAdams&dt=02/25/2008&page=full&comments=true&submitted=true6def8a2e-37e5-4c46-b43d-af7e9798ae98

"The Vagina Monologues" promotes lesbianism, pedophilia, and the view that men are violent, women are victims. The play shows men as rapists, predators, and aggressors. In between, skewed feminist statistics are offered to support an anti-male worldview.

The play is showed in High Schools and college through out America.

Here's another family court induced murder, reported by CNN. This time the dad, a former police officer, snapped:

"Prosecutors discounted Cutts' story, claiming he buckled under the financial pressure of child support, killed the mother of his child and then created a cover story to try to get away with it."

Right. So what did make him snap? Duh.

Below is the whole report from CNN today.

American family court has caused more murders of Americans than Al Queda, Bin Laden and all Iraqi forces combined.

This death was of a child and the child's mother. Very sad. And very typical of the ever-lengthening trail of bodies behind the American "family" court money train.

    CNN Reported today as follows:

Bobby Cutts Jr. faces the death penalty for murders of girlfriend, unborn child

Cutts also could receive life sentence, with or without parole

Same jury that found Cutts guilty is hearing penalty phase of trial

(CNN) -- A former police officer convicted of murdering his girlfriend and their unborn child tearfully apologized to her family Monday in front of the jury that will decide whether he lives or dies.

"It was a nightmare that will continue to haunt me for the rest of my days," said Bobby Cutts, Jr., 30, reading from a prepared statement at the penalty phase of his murder trial.

"Ladies and gentlemen of the jury, I'm asking you to spare my life."

Cutts was convicted on February 15 of the murder of girlfriend Jessie Marie Davis and the aggravated murder of the unborn girl Davis had planned to name Chloe.

Chloe's slaying, which jurors found occurred during the commission of another crime, makes Cutts eligible for the death penalty

"To imagine that I was responsible for the death of Jessie, the mother of my children and my unborn daughter, is beyond any words that I can express," Cutts said. "Words cannot bring them back, nor can they erase the pain I've caused, but I want to apologize." Watch Cutts' tearful apology »

He thanked Davis' family for taking care of the other child he had with Davis. Blake was 2½ at the time of his mother's murder in June 2007.

"I pray that you find peace and you someday find room for forgiveness," he said.

Earlier, Cutts' mother, Renee, Jones, had told jurors, "I don't know what I would do without him." She described Cutts as a former honor student who loved his job as a police officer.

"He was my firstborn, my only son," Jones testified tearfully. "He means so much to me," she continued. "He used to call me three, four times a day."Watch Cutts react as his mother pleads for his life

Cutts' punishment is being decided by the same jury of six men and six women who found him guilty. All the jurors are white; Cutts is African-American.

Cutts' sister, father and one of his school teachers also testified.

Judge Charles E. Brown ordered jurors to return early Tuesday for attorneys' closing arguments. When they arguments conclude, jurors will begin their deliberations.

If jurors do not agree on the death penalty, Cutts could receive a possible sentence of life in prison without parole or become eligible for parole in 20, 25 or 30 years.

Jones, was the first witness called to the stand by the defense. She said her son was a good youngster who was active in sports, Scouts and his church.

"I never had any trouble out of him," she said as Cutts teared up at the defense table. She said Cutts' relationship with his father deteriorated after the parents split.

A former teacher described Cutts as a social child given the nickname "Gobble" by his classmates. He was helpful in class, often volunteering to pick stray crayons up from the floor.

His father testified that he gave Cutts the nickname "Gobble" because as an infant he resembled " a little Butterball turkey." He said Cutts was a "gifted child" in school.

He blamed himself for the break up of his marriage, saying his drinking and gambling contributed to it.

Cutts' own personal life was rocky, according to testimony. Davis was nine months pregnant when she disappeared in June 2007. Her body was found in a northeastern Ohio park after a 10-day search that brought national media attention

He is Blake's father, as well as the father of the unborn girl, Chloe.

According to testimony, Cutts, 30, rolled Davis' body in a comforter and dumped it in a park, leaving toddler son Blake in the house alone at the crime scene in a soiled diaper.

"Mommy's in the rug," Blake told police, according to testimony.

During the guilt phase of the trial, Cutts sobbed on the witness stand as he admitted killing Davis and Chloe. But Cutts insisted that their deaths were an accident.

"I didn't mean to hurt her," Cutts testified, clasping a handful of tissues. "This isn't real," he said he kept telling himself.

Prosecutors discounted Cutts' story, claiming he buckled under the financial pressure of child support, killed the mother of his child and then created a cover story to try to get away with it.

On the stand, Cutts said he went to pick up his son, Blake, and became agitated when Davis, 26, wasn't moving fast enough to get the boy ready. He said he tried to leave her house, but she grabbed him to keep him from leaving, and he accidentally elbowed her in the throat.

Cutts told the jury he performed CPR on Davis and then tried to revive her with bleach. When he realized Davis was dead, Cutts said he panicked and put her in the back of his truck, so Blake wouldn't have to see his mother.

  25. Jay R Says:

Anyone who thinks that the lives of mere children are more important than preserving intact the grinding machinery of "family" law and continuing the "protection" of the "fairer" sex is naive, I am sad to say.

  26. AnonymousPamphleteer Says:

Jay R makes a good point.

It is clear that other Americans can be counted upon to have more children to replace the people murdered as a result of adults snapping due to their encounters with "family" court.

But it is not at all clear that most of the type of "lawyers" who "practice" in America's family courts could ever find a job doing anything else at similar pay.

So is that why the greatest single coherent source of terror and murder in America is allowed to continue its carnage?

Because we cannot bear to have unemployed family court lawyers in this country?

Well, that might in fact be the explanation.

The lawyers union is perhaps the strongest, and most politically enhanced, of all unions. They get to make their own rules even in our legislatures. Follow the money.

It's one of the reasons - modern media is another - I believe our form of representational democracy is doomed.

George... the judge did the right thing by me. The person that should have reimbursed for the CE and the related testing was the evaluator and the doctor charged with presenting an unbiased report. The judge simply recognized it for what it was after 2 full days of testimony which included flabbergasting comments from the CE like: "[The mother's] history of suicide threats during and before the marriage are of no concern to me in terms of her ability to be a good parent." (That's not a direct quote but paraphrased as the hearing was more than a year ago.)

I'm not making it up. I wish I could afford the transcript of that particular hearing because it was mind-boggling.

It's clear to me that the family law system cannot be successfully rehabed anymore than a Communist country. The evidence is overwhealming- what's it going to take ??

  32. AnonymousPamphleteer Says:

What it is going to take the the complete shut down of family courts in America.

    That is the only way.

  33. George Says:

Guys, despite how gruesome this story is, I have to laugh at those scare quotes around the word "violent" when talking about the murderous mom. I don't know what your experience is, but nobody ever refrerred to me as "violent", just VIOLENT.

"Nassau County killed these kids," said Innocent Demesyeux, 28, who claimed county authorities ignored his pleas to protect Michael, 5, and Innocent Jr., 18 months, from their "violent" mother, Leatrice Brewer, 27.

  34. Mike Says:

    This is similar to what happened to me. My wife was off her meds, and because of her behavior towards our son, I was forced to call 911. The police shared my concern and transported my wife to the county social services office. The social workers treated my wife as a domestic violence victim; they allowed her family to come and take her and our son out of state, where she filed a domestic violence action against me and received an ex parte order barring me from having any contact with my son. That lasted 7 months, until I finally was to get a trial, then she dismissed it - I was going to call the`police officer as a witness, and my wife didn't want that testimony in;

Now we're in court and the judge assumes that although I never got a trial, and although the police report is consistent w/ my side of the story, I'm the violent father, and my son would be better off having only limited contact with me. It's insane because I can prove what I'm saying is true, various witnesses side with me and with my version of events, but the court has said a child is better off with his mother and should not spend extended periods away from her, and should not have to travel to the state where my wife fled from for me to visit with him. I can prove my wife has repeatedly violated the court's orders, and the court's response each time is that well, I had a protection order against me so I'm lucky to have even minimal contact with my son. It's unfair, I never even got a trial but they assume I'm guilty, solely on my wife's word, and won't consider any evidence to the contrary.

  35. Mike Says:

by the way, off the subject sort of, did you see Judge Judy on domestic violence, bashing the "violent man" it was insane, the worst anti-male bashing I think I've ever seen - it was on maybe 2 weeks ago.

the "case" involved an attrative and fairly aggressive girl vs. an unattrative and quiet/shy/nervous looking guy, who the girl claimed had repeatedly physically abused her, was a drunk and didn't hold down a job. Judge Judy just completely slammed the guy, every time he tried to state his side of the story, or deny the allegations, "Judge" Judy would interrupt him and berate him. It was terrible, and any idiot could see the girl accusing him was a lot more aggressive than the guy, but he was a man, and the accuser was a woman, and so it must be true.

  39. gwen Says:

Family law did not come into bloom until the late 50's early 60's. Up until that time men could divorce their wives, get the kids property, etc... Women had no recourse. Also, the number of pages in a divorce decree were usually under 10.

Fast forward to today - divorce decrees are 30, 40, 50 pages or more, so much of which consist of the family code. No matter the enormous involvement of the courts, these orders are still just pieces of paper. The focus for the family courts is supposedly the best interest of the children. It is common for divorce attorneys to advise their male clients to behave, because one little blip out of Mom that he pushed me first, and hubby is hit with a protective order. Another common ploy is for Mom to claim Dad touched the kids in their naughty spots, and a new can of worms is opened.

Less government is better, but we have a whole society of adults who at the very least can not afford enough decency to do what is best for their children, and the worst of which involves drugs, alcohol, and a greed beyond reprehension. In my own experience, (13 years ago) when my ex-h. was knee deep in drug addiction, I did whatever was necessary to protect my children. If I had waited for the courts to intervene, they might not be here. About Judge Judy, she is performing and raking in millions. Got to keep those ratings good!!!
